Montana man charged with shooting teen in his garage


MISSOULA, Mont. - A man has been charged in the shooting death of a 17-year-old boy after prosecutors said he set a trap in his garage to catch any would-be burglars because he was frustrated over recent thefts.

Markus Kaarma, 29, made an initial appearance in Justice Court on Monday but did not enter a plea to the count of felony deliberate homicide filed in the death of Diren Dede, an exchange student from Hamburg, Germany.

Kaarma's attorney, Paul Ryan, said his client feels terrible about the death of the young man, but he was also was disappointed that the Missoula County attorney filed the charge.

Ryan told CBS affiliate KPAX his client will plead not guilty and will fight the charge all the way.

Court records said Kaarma and his common-law wife, Janelle Pflager, had set up sensors outside the garage, a video monitoring system in the garage and left the garage door open. Pflager said she put personal items that she had cataloged in a purse in the garage "so that they would take it."

Early Sunday, the sensors went off, and Kaarma and Pflager looked at the video feed and saw that someone was in the garage.

Kaarma went outside with his shotgun. He told investigators he heard a noise that sounded like metal on metal, and he http://www.colorado-garage-door.com/ was afraid the intruder would come out and hurt him. He said he did not see anyone in the darkened garage and did not communicate with anyone before sweeping the garage with four shotgun blasts.



Dede was a junior at Big Sky High School. He was an All-State soccer player and also competed in track. Monday was a scheduled day off in the Missoula County Public School District, but KPAX said counselors were made available to students.

On Sunday, a woman told investigators that Kaarma had told her that he had been waiting up for three nights with his shotgun to shoot a kid, court records said.



Justice of the Peace Karen Orzech set Kaarma's bail at $30,000.

Kaarma's arrest comes as a man is on trial in Minnesota for fatally shooting two teenage intruders in his Little Falls home. Byron Smith, 65, is charged with first-degree premeditated murder in the deaths of 18-year-old Haile Kifer and 17-year-old Nick Brady.

Smith contends he was defending himself when he shot the two cousins in his basement because he feared for his life after several break-ins. Prosecutors say he lay in wait for the teens.

According to an affidavit filed by prosecutors, Pflager told investigators that Kaarma yelled into the garage, and that someone responded either "hey" or "wait." Soon after, Kaarma fired four shots into the dark garage, she said.

Dede was struck in the head and arm and died at a Missoula hospital, court records said.

Kaarma said he didn't want the suspect to get away and added that police can't catch burglars in the act, the affidavit filed Monday said.

Pflager told police that they had been burglarized two times within the last three weeks. Ryan said.

They were frustrated, on edge and felt someone in their neighborhood was watching them, Ryan said. The couple called police "and nothing was done," he said.

Pflager had made a list of the items in the purse so if it was taken she could attempt to track the thief, Ryan said. Despite the recent burglaries, they left the garage door open, prosecutors noted.

"They certainly didn't tell the kid to come in (the garage)," Ryan said. "He entered voluntarily."

Nine of the "top 10 most cost-effective projects nationally" are exterior replacement projects. Realtors rated exterior replacement projects the most cost-effective home improvement projects in terms of value recouped after resale of the home (one year after the remodeling project was completed).

A garage door repair entails checking if it properly opens and closes. The things you need are common sense and some common household repair tools. Repairing a Roll-up Door



Start off with checking the metal tracks holding the wheels in case of a rolling door for obstacles or blocks. Too much of dirt in the tracks leads to sticking of the door. If the track is damaged, bent or not in a good shape, use the mallet to get the tracks in shape by working on the ridges. This will facilitate smooth movement. A level will help you know if the tracks are in alignment. Over time loose screws can result in shifting of the tracks at an angle which is not perpendicular to the garage door. So, with the screwdriver, tighten all the screws holding the tracks in place. If the tracks are in a very bad condition, well, they would need to be replaced. For repairing a dysfunctional garage door, first clean and lubricate the wheels. An irony is that the grease used to lubricate the parts of the garage door earlier, sometimes hardens in the crevices rendering the door dysfunctional. Check the springs for extra tension. Majority of the spring doors have a hook at the end of a spring that can be adjusted in a different hole. Man Posts Secret Video of Car Repair - Then Gets Sued


A car dealership in Missouri is suing a customer who is alleged to have secretly recorded repairs and posted the video online.

Jim Butler Chevrolet of Fenton, Mo., about 19 miles southwest of St. Louis, claimed in its http://www.denveroverheaddoors.com/ lawsuit that it charged for 5.5 hours of labor but Dwayne Cooney's video claims the time was much less.

Cooney brought in his 2007 Chevrolet Malibu on Friday, Jan. 31, for a few repairs, according to the lawsuit filed last month in St. Louis County Court that said Cooney agreed to two hours of diagnosis time at $129.95 an hour.

Cooney, 42, told the dealership he needed three repairs -- for the tire sensors, key fob and the air bag light, according to the lawsuit.

Dwayne Cooney is being sued for defamation related to his YouTube video.In mid-February, Cooney published a 17-minute video from his dashcam onto YouTube, called "Dash Cam Video: Dealer Charges 2 Hours to Move Fuse," describing about 45 minutes of work, the lawsuit claims.Cooney claimed in the video, which has received thousands of views, "The airbag problem was a fuse was displaced and all he had to do was move the fuse. I was billed 2.5 hours for the airbag repair," according to the suit.

"We were shocked when this video showed up online and he refused to acknowledge the prior three hours of work in his 17 minutes," said Brad Sowers, co-owner and general manager of Jim Butler Chevrolet. "As a small family-run business, weve got to protect ourselves. This is part of the Internet world. People can say whatever they want until proven false in the court of law."

The dealership is suing for more than $25,000 in damages.

Cooney said he has cameras installed at his home and in his cars for safety, according to the St. Louis Post-Dispatch.

We have them in all our vehicles, and they record 24 hours a day for the protection of our family and our vehicles, he told the newspaper.

Cooney and his attorney have not responded to a request for comment from ABCNews.com.

On Saturday, Feb. 1, the dealership called Cooney to inform him it would not be able to diagnose his car that day, apologizing and offering a free rental car, which Cooney accepted, the suit stated. On Monday, a technician at the dealership began diagnosis of the problem, working 3.22 hours, the dealership claimed in its suit. The technician called Cooney that day to let him know he would need another two hours, to which Cooney agreed, according to the suit.

The task was complex because no diagnostic codes were revealed by the GM tech equipment, the court filing said.

Three days later, technicians finally made the necessary repairs and fixed the issues, tallying more than five hours of work on the vehicle, the complaint said -- though the dealer only charged Cooney for 4.5 hours: $602.32 instead of $668.38 for five hours.

After negotiating with the dealership, Cooney agreed to a further-reduced bill of $553.61, which included parts and tax, the suit stated.

I never disputed that they worked on it on any previous day, Cooney told the St. Louis Post-Dispatch. The question is, if you did, what did you do?

Cooney told the Post-Dispatch that the dealership offered to drop the suit if he deleted the video and paid $8,000 of the dealers legal expenses, but he has refused.

We offered on several occasions to settle this for a simple apology and a partial refund. Jim Butler insists on suing a former loyal customer, Cooney told the newspaper.



Computer records show how long the technicians worked on the car and that the dealership tried to meet with Cooney "many times" to no avail, Sowers said. The dealership wants an injunction to remove the video.

With the help of the non-profit group, Public Citizen, Cooney's homeowner's insurance company hired a lawyer to represent him, blocking a temporary restraining order to unpublish the video.

"If the defendant has made a false statement of fact about the plaintiff with negligence or actual malice, the plaintiff gets an award of damages, perhaps even punitive damages, but it cannot get an order requiring that the allegedly defamatory material be taken down in the interim," wrote Paul Alan Levy, the Public Citizen attorney whom Cooney contacted, in a blog post.

Cooney, who has not yet filed a legal response, has been summoned to a hearing next Monday.

In the meantime, the dealership has created its own website, Gatewaydashcam.com, with an open letter to customers explaining its side of the story.
